1. Who We Are and What These Terms Cover
Five ID Limited ("Five ID", "we", "us", "our") is a company registered in England and Wales under company number 15793519. We operate a biometric palm authentication service that lets you use your palm to verify your identity at Five ID-enabled terminals (the "Service").
These Terms and Conditions ("Terms") apply to your use of the Service. By creating a Five ID account and scanning your palm, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
Each use case we support is called an "Ancillary Service". Ancillary Services have their own additional terms that apply alongside these Terms. Where any conflict exists between these Terms and an Ancillary Service's terms, the Ancillary Service terms take precedence for that service.
2. What Five ID Does
Once you have registered, you can use your palm to:
authenticate payment transactions at participating merchants ("Payment Authentication") — governed by our Payment Processing Terms;
gain access to premises or facilities at participating locations, for example a gym door ("Access Control"); and
receive loyalty credits at participating loyalty programmes by palm scan ("Loyalty Authentication — Palm-Linked").
Five ID also operates a separate Card Fingerprint Loyalty service which is governed by terminal consent and our Privacy Policy, not by these Terms — see clause 6.4.
We will notify you if we add new Ancillary Services that affect how we process your data.
3. Creating Your Account
3.1 Eligibility
You must be at least 18 years old to use the Service.
3.2 How to register
To create a Five ID account, you must: (a) scan your palm at a Five ID terminal; (b) provide the personal information we request; and (c) agree to these Terms and our Privacy Policy.
3.3 Keeping your details accurate
You are responsible for ensuring your contact and account details remain accurate and up to date. Please notify us of any changes at support@five.id.
4. Your Palm Signature
4.1 What we collect
When you register, we create a mathematical biometric template from your palm scan (your "palm signature"). This template is used to verify your identity each time you use a Five ID terminal.
4.2 How we use it
We use your palm signature only to: (a) verify your identity and prevent fraud; and (b) instruct Ancillary Service providers to perform the relevant service — for example, initiating a payment, unlocking access, or crediting a loyalty account. Full details are in our Privacy Policy.
4.3 Storage and security
Your palm signature is stored in encrypted form on our secure cloud infrastructure. We do not sell your palm signature to any third party. For full details of how we protect and retain your biometric data, please see our Privacy Policy.
4.4 Separate consent
Your consent to biometric data processing is a separate and specific consent — it is not bundled with your acceptance of these Terms. You will be asked to give explicit consent for biometric processing during onboarding, distinct from agreeing to these Terms. You may withdraw that consent at any time by contacting us at dpo@five.id (see clause 4.5 below).
4.5 Withdrawing consent and fallback authentication
You have the right to withdraw your consent to biometric data processing at any time. Withdrawal will not affect the lawfulness of processing that has already taken place.
If you withdraw consent or are unable to use biometric authentication for any reason, please contact us at dpo@five.id. We will arrange an alternative means of authentication where this is technically feasible. Withdrawal of biometric consent alone will not immediately terminate your access to Ancillary Services — we will work with you to maintain access where possible.
5. Using Your Five ID at a Terminal
When you hold your palm over a Five ID terminal, the following happens:
we create a mathematical representation of your palm;
we transmit an encrypted version to our secure server;
we compare those measurements against our database of registered customers; and
if you are matched as a registered customer, we authenticate your identity and communicate the relevant instructions to the Ancillary Service provider.
Important: our system can only determine whether you are a Five ID customer after the palm scan has been taken and processed. Terminal signage on-screen and our Privacy Policy explain this process before you use the terminal.
6. Our Ancillary Services
6.1 Payment Authentication
If you have registered for our Payment Processing Service, we will instruct our payment partner to initiate a payment transaction when you authenticate via a Five ID terminal at a participating merchant. Full details, including your rights in relation to payments, are set out in our Payment Processing Terms.
6.2 Access Control
If you have registered for access control at a participating location — for example, to enter a gym or workplace — when you scan your palm at the relevant terminal we will communicate with that location's access management system to confirm if you have access and grant it accordingly.
The access management system at each location is operated by the venue or by a third-party provider contracted by the venue, not by Five ID. Five ID's role is limited to authenticating your identity. We are not responsible for the operation, availability, or security of any third-party access system.
Your enrolment for access control at each venue is a separate step and requires your specific consent at that venue. You may withdraw your access control enrolment at any time by contacting us at support@five.id or the relevant venue directly. Withdrawal will not affect your Five ID account or other Ancillary Services.
6.3 Loyalty Authentication — Palm-Linked
If you have linked a loyalty account with a participating loyalty programme, Five ID will instruct the loyalty operator to credit your account each time you authenticate by palm scan at a participating terminal.
Linking your loyalty account requires your specific consent, obtained separately during enrolment at the relevant terminal or application. You may unlink your loyalty account at any time by contacting us at support@five.id or at any Five ID terminal. Unlinking removes the connection between your palm signature and your loyalty identifier — it does not delete your loyalty account with the operator, which is governed by the loyalty operator's own terms.
We share your loyalty account identifier and authentication event data with the relevant loyalty operator. Each loyalty operator is an independent data controller in respect of your loyalty account. For full details see our Privacy Policy.
6.4 Loyalty Authentication — Card Fingerprint
Five ID operates a separate Card Fingerprint Loyalty service which allows any person — whether or not they hold a Five ID account — to link a payment card to a participating loyalty programme by pressing the consent button at the terminal at the time of payment. Because this service is available without a Five ID account, it is governed solely by the consent given at the terminal and our Privacy Policy. These Terms do not apply to use of the Card Fingerprint Loyalty service.
7. Communications
By agreeing to these Terms, you consent to us sending you service notifications by SMS and email — for example, payment confirmations and important account notices. All communications we provide electronically satisfy any legal requirement that such communications be in writing.
You may withdraw your consent to marketing communications at any time without affecting your ability to use the Service.
8. Changes to the Service and These Terms
We may update these Terms from time to time. We will give you at least 30 days' notice of any material changes before they take effect, except where changes are required urgently for legal or security reasons.
You will be asked to confirm acceptance of the updated Terms when you next use the Service. If you do not accept the changes, you may close your account by contacting us at support@five.id before the changes take effect. If you continue to use the Service after the effective date, you will be treated as having accepted the updated Terms.
We may suspend or discontinue any part of the Service where reasonably necessary for operational, security, or legal reasons. We will give you as much notice as is reasonably practicable.
9. Closing Your Account
You may close your Five ID account at any time, free of charge, by contacting us at support@five.id. There is no minimum commitment period.
When your account is closed, we will stop processing your biometric data for authentication purposes and your access to Ancillary Services that rely on Five ID authentication will end. We will delete or retain your personal data in accordance with our Privacy Policy. If you wish to use Five ID in the future, you will need to create a new account.
10. Our Liability to You
10.1 What we will do
We will provide the Service with reasonable care and skill, as required by the Consumer Rights Act 2015 (UK) and the Irish Consumer Rights Act 2022. If we fail to do so, you may be entitled to a remedy under those Acts.
10.2 What we are not responsible for
We are not liable for: (a) losses that are indirect, consequential, or speculative; (b) failures by any merchant, loyalty operator, or access control provider to fulfil their obligations to you; (c) failures of the Service caused by circumstances outside our reasonable control, including network outages, third-party system failures, or force majeure events; or (d) losses arising from the payment processing, fund management, or direct debit collection activities of our payment processing partner or any other third-party payment service provider.
10.3 Liability cap
Subject to clause 10.4, our total liability to you under these Terms is limited to £100 (or €100 for users in Ireland) per claim.
10.4 Uncapped liability
Nothing in these Terms limits or excludes our liability for:
death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
any breach of the implied term of reasonable care and skill under the Consumer Rights Act 2015 or the Irish Consumer Rights Act 2022;
any claim under UK GDPR Article 82 or EU GDPR Article 82 for breach of data protection obligations; or
any statutory right that cannot lawfully be excluded. For the avoidance of doubt, your rights under the Payment Services Regulations 2017 (UK) or the European Union (Payment Services) Regulations 2018 (S.I. No. 6/2018) (Ireland) in relation to unauthorised payment transactions run against our payment processing partner as the regulated payment service provider, not against Five ID.
11. Geographic Scope and Governing Law
The Service is available only in the United Kingdom and Ireland.
UK users: These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute, subject to your right as a consumer to bring proceedings in the courts of your place of residence.
Irish users: These Terms are governed by the laws of Ireland. The courts of Ireland will have exclusive jurisdiction over any dispute, subject to your right as a consumer to bring proceedings in the courts of your place of residence.
12. General
12.1 Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be treated as deleted. The remaining Terms will continue to apply.
12.2 Entire agreement
These Terms, together with the relevant Ancillary Service terms and our Privacy Policy, constitute the entire agreement between you and Five ID in relation to the Service.
